Personal Data Disclosure Statement

Promar Tarım ve Tekstil Ürünleri Pazarlama A.Ş. (“Promar” / “Company”) places great importance on the security and confidentiality of your personal data. Your personal data is processed, stored, and protected in accordance with the principles and conditions set forth in the Law on the Protection of Personal Data No. 6698 (“KVKK”). As a company committed to utmost care in protecting data, we would like to inform you about how your personal data is processed.

Principles of Personal Data Processing

Your personal data is processed in accordance with the following principles:

  • Compliance with the law and honesty,

  • Accuracy and, when necessary, updating,

  • Processing for specified, explicit, and legitimate purposes,

  • Being relevant, limited, and proportionate to the purposes for which they are processed,

  • Retention for the period stipulated by law or necessary for the purposes of processing.

Disclosure Obligation

Article 10 of the KVKK requires data controllers to inform data subjects about the processing of their data. In this context, Promar as the data controller provides information about:

  • The identity of the data controller and, if any, its representative,

  • The purposes of processing personal data,

  • The recipients to whom personal data may be transferred and for what purposes,

  • The methods and legal reasons for collecting personal data,

  • The rights of data subjects under Article 11 of the KVKK.

Identity of the Data Controller

According to Article 3(1)(ı) of the KVKK, the data controller is the real or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data recording system. Purposes of Processing Personal Data

Your personal data is processed only with your explicit consent or under the legal grounds stated below:

  • Explicit provision by laws,

  • Necessity for protecting life or physical integrity of a person who cannot give consent,

  • Direct relation to establishing or performing a contract,

  • Fulfilling legal obligations of the data controller,

  • Being made public by the data subject,

  • Necessity for legitimate interests of the data controller without harming fundamental rights and freedoms.

Special categories of personal data (e.g., racial origin, health data) are processed only with explicit consent unless otherwise provided by law. Your personal data is processed for commercial, marketing, operational purposes, customer satisfaction improvement, and fulfilling legal obligations.

Transfer of Personal Data

Your data may be shared with private and public institutions, business partners, and official authorities when necessary for the above purposes or to comply with legal obligations. Transfers comply with Articles 8 and 9 of KVKK and include all technical and administrative safeguards. International transfers require adequate protection in the receiving country as determined by the Personal Data Protection Board.

Method and Legal Basis of Data Collection

Your personal data is collected through physical, electronic, or other means and processed in accordance with legal provisions and, where necessary, with your consent.

Rights of Data Subjects

You have the right to:

  • Learn whether your personal data is processed,

  • Request information if your data has been processed,

  • Learn the purpose of data processing and whether it is used accordingly,

  • Know the third parties to whom data has been transferred,

  • Request correction of incomplete or inaccurate data,

  • Request deletion or destruction of data when legal requirements are met,

  • Request notification of corrections or deletions to third parties,

  • Object to automatic data processing resulting in adverse decisions,

  • Request compensation for damages caused by unlawful processing.

You may exercise your rights by submitting a written request or using methods specified by KVKK. Requests will be processed free of charge within 30 days, except for fees related to responses exceeding ten pages.

Data Protection Measures

We implement all necessary technical and administrative measures to protect your personal data from unauthorized access or misuse. Our software complies with industry standards, employees receive regular training, and our partners are carefully selected.

Application and Contact

To exercise your rights, you may apply:

  • In writing or in person with identification,

  • By notary or registered mail,

  • Via secure electronic signature, mobile signature, or registered electronic mail (KEP).

Responses will be provided within 30 days from the receipt of your application, in writing or electronically. Fees may apply for responses exceeding ten pages.
